Hong Kong plans universal AML requirements for OTC crypto traders
The Hong Kong government is set to enhance the regulation of over-the-counter (OTC) trading of virtual assets by applying the same Anti-Money Laundering (AML) and Counter-Terrorist Financing requirements as those in place for retail virtual asset trades. A consultation paper released on February 8th outlines a two-month consultation period ending on April 12th, aiming to bring OTC trading under the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (AMLO) from June 2023. OTC trading, which involves direct transactions between providers and customers without a centralized exchange, will only cover "spot trade of any virtual assets for any money" under the proposed regulations. Peer-to-peer trading remains excluded.
The proposed regulation mandates that OTC traders obtain a license from the Commissioner of Customs and Excise, provide a local management office address, a correspondence address, and a location for storing records. Transactions will be limited to registered wallet transfers, requiring clients to verify wallet ownership. Trading of unlisted virtual assets or stablecoins by unlicensed issuers will be prohibited. The move comes as part of a broader clampdown, with a recent announcement setting a May 31 deadline for unlicensed virtual asset service providers to cease operations if not approved.
