China Never Completely Banned Crypto

Despite widespread perception of a crypto ban in China, the reality is more nuanced. While the government has implemented crackdowns and restrictions, crypto trade persists due to loopholes in the regulations. Chinese law does not explicitly prohibit individuals from holding or trading crypto, although such activities lack legal protection. Despite crackdowns in 2013 and 2017 on financial institutions' involvement and initial coin offerings, crypto trade continued albeit in a gray area. Even the 2021 extensive regulations didn't explicitly ban personal crypto holdings or peer-to-peer trading. Enforcement remains challenging due to decentralized nature, with Chinese traders still active on overseas exchanges and using social media for peer-to-peer transactions. The government's intention seems to be raising barriers to entry rather than wiping out crypto entirely, aiming to prevent mass investment by unsophisticated investors and maintain social stability. This approach aligns with China's cautious stance on crypto while embracing blockchain technology and exploring its own central bank digital currency. Additionally, Hong Kong's relatively crypto-friendly environment may serve as a way for China to stay engaged in the crypto sphere while managing risks.
