VanEck admits ETF marketing violation, agrees to SEC fine
VanEck agreed to a $1.75 million fine to settle SEC charges over undisclosed marketing practices for its 2021 Social Sentiment ETF launch. The SEC highlighted VanEck's collaboration with a prominent social media figure, not named but reported as David Portnoy, to promote the ETF without fully disclosing the influencer's compensation being tied to the fund's growth. This arrangement was not disclosed to the ETF's board, violating oversight responsibilities and transparency requirements under the Investment Company Act and Investment Advisers Act. VanEck accepted the SEC's order, including a cease and desist, censure, and fine, without admitting or denying the findings. This action comes amid VanEck's decision to lower fees for its Bitcoin ETF, aiming to boost its appeal following the discontinuation of another ETF product.
